i think the way it works is your contract is with the seller, don`t let them fob you off with telling you to go to toshiba, you should tell them as it has broke in less than 14 days it is "not fit for purpose" & that you want a replacement or refund.

Sale of Goods Act 1979 states that you are entitled to return the item for ANY reason to your retailer within 28 days of purchase. Therefore that is the best course of action for you. However, your retailer may be like Comet and try and push you in the direction of the manufacturer and get you to go direct to them for the repair. You do not have to accept a repair though as still in the 28 days mark so can just demand a refund or replacement. If you do accept a repair then you may be better off just going direct to the manufacturer as you will cut out the middle man. In any event your contract for repair/warranty for the first 6 months is with the retailer so they are obliged to rectify any problems that arise. However, as mentioned a retailers way of recitifying a fault is to just act as a middle man to return an item to the manufacturer so it can be simpler just going direct.
I am not a legal expert though so please don`t rely on my words. I am quite well versed in consumer and contract law though so confident in my advice.

I don`t think the first sentence is quite right but otherwise spot on.

The key is to legally reject the goods. You are entitled to a refund or a replacement - do not accept a repair.

The most important thing is to do it quickly

If you buy a Toshiba from PC world and it needs a repair, you are expected to contact Toshiba direct.
Quite an efficient repair service, I`ve (unfortunately) had to use it twice.
Once was a complete crash (blue screen of death)
Once was a fecked keyboard.

Moot point in this case though, as you should definitely get a whole new machine.
Out of sheer nosiness, what happens to any hard-drive info on a returned machine???

Under the SOGA (unless it`s changed drastrically since I left) you are entitled to a replacement/refund on a unit with a fault up until it is 6 months old as long as it can be reasonably proved the fault existed at time of purchase.

In the case here, 2 week old laptop with a fault would be refunded/replaced if proven to be faulty (I`ve lost count how many times I had the same fault reported and they had hit the Fn key for external monitor!!)

However couple of points to correct: You can only return a unit that is faulty or missold/misrepresented/ incorrectly supplied. No other reason unless the Retailer offers this benefit.
Your contract is with the Retailer at all times. They may ask you to go through a Manufacturer to effect repairs but this does not absolve them of their responsibilities.

The contract should you wish to pursue it is that the unit should be Fit for Purpose for a period of approximately 6 years from date of purchase but excludes normal breakdown due to wear and tear or part life. It isn`t reasonable to accept a hard drive working every day for (x) hours would last 6 years but it is feasable to have a dishwasher used once a day to have the programmer last 6 years. (etc etc)

To clarify that, 6 years Fit For Purpose and free from premature failure due to whatever reason other than customer, accidental or those above. Burden of costs in the proof usually are on the customer too.

I know, doesn`t matter here. It`s 2 weeks old. If it IS a faulty screen (not software or user error/damage) insist on a new one. Retailer has no grounds to refuse unless it`s your fault or a refurb.
