Consumer Rights Question

BigmanInc (Elite) posted this on Saturday, 24th March 2007, 16:09

Okay, heres the story. I bought the new arsenal shirt from the Arsenal shop in the summer, and very quickly the `fly emirates` logo started to peel off. The club have now acknowledged that this was a production problem affecting a large number of shirts, and have agreed to replace faulty kits. However, they are demanding a receipt to prove i bought it at the arsenal shop before they will exchange it. I have no receipt, I most likely binned it at the time - i do have a bank statement showing that i made a purchase at the shop, but obviously it does not prove it was the shirt.

My question is that as faulty goods, surely they have a responsibility to replace them even without a receipt? Its not coming out of their pockets anyway, so even if i bought it elsewhere, surely costs will be carried by the manufacturer? Anybody got any suggestions?

In a court of law, a bank statement is more than enough to prove you purchased it believe it or not.

You proved you bought something from them, and you are saying it is that shirt. It is then up to the retailer to proove or disprove it was that particular item.

Just pop in with your bank statement and i`m sure they wont give you any hassle..

I would imagine that just the date of purchase would be enough. Their computerised records should be able to tell them exactly what you bought and at what time and who the till person was, etc, etc.

It`s like the old manual tills in the past where you could only go by prices that appeared on a receipt....
