They sent the wrong film - what are my rights?

jubbly (Competent) posted this on Friday, 18th May 2001, 09:33

I ordered Payback (well I liked it anyway!) from DVDPlus yesterday & it arrived this morning, but it was the wrong version.
On their website there were two versions of the film, both the same (same cover, both had different blurbs of the film but both were for the Mel Gibson version) but with 2 different prices: £8.50 & £13.50. Of course I ordered the £8.50 version (I figured that either they`d made a cock up with the pricing on the £8.50, or one was a sp. ed). When the film arrived it was the wrong film - some tosh with Mary Tyler Moore.

Where do I stand with my rights? Should they honour the £8.50 on the Mel vsn being that it was advertised at this price (& it`s not a rediculous price, i.e. WHSmiths 99p Fight Club)?

Thanks in advance...

er mate.... you just ordered the wrong disc

just deal with it and get it replaced, it`s not a rights issue. who needs to make anything legal out of it?
if you explain to them what happened they`ll tell you what they can do - probably get you to send it back and then they`ll refund postage and send you the right one.

My mate had trouble like this, not with DVDplus. Looking at their "Our promise to you" in the "About Us" section they state

"You can have complete confidence in buying from DVDplus, because we will gladly accept back any product which you are not happy with - as long as it`s in original condition (still shrinkwrapped)and within 10 business days from the date of shipment"

They`ve got a customer services number on there as well.

er mate... I`m not sure you got the point. I ordered the right disc, but they sent me the wrong one. It`s clear that they`ve got a cock-up on their website, but that`s not my fault. When I clicked `buy this DVD` it was showing the one I wanted at £8.50.

Cheers anyway.

But according to their system they have sent you the right disc:-

http://www.dvdplus.co.uk/cgi-bin/DVDplus.storefront/1043673656/Product/View/ODX20025

If you check the reference number at the end at another retailer:-

http://www.dvdstreet.infront.co.uk/cgi-bin/show?Key=dvd-ODX20025

you`ll see that it is the old version. However, DVD Plus are quite clearly advertising it as the new version with Gibson et al. Seems like someone made an error when they put the details in the database.

They just phoned me back & yep they admit there is a cock-up on their site, but are going to send me the correct version (which should be at the higher price) for no extra cost & also pay for the return of the other disc. Good show chaps.

One question though, this is the 2nd order I`ve got from these guys & each has come with a free lego bike - `eh? I`ll have the whole fleet before the year is out! Anyone like lego?
