LCD dead out of the box, replacement rights advice needed urgent

OK, obviously I`m the black widow of TV owners.....as another one bites the dust.

OH made an impulse purchase on Sunday of a Toshiba LCD from Comet ,to take back to the Isle of Man.

On setting it up he found there was no power to the tv. Toshiba posted him a new adapter, TV now has power, but screen is a mass of lines and won`t tune, no controls work.

On phoning Comet, they`ve told him he has to accept a repair and wait 3wks. I thought if an item was dead out of the box, you had 28 days to get a replacement. Have looked on trading standards and can`t seem to find if this is law.

As the tv is now in the Isle of man, we need to know if OH can risk buying another tv out there in lieu of getting a refund when he returns to the UK (which will be within 28days)

Hi, thanks for the link. It pretty much quotes the sale of goods act, which is really woolly in terms of actual timescales.

Sale of goods act says you are entitled to a refund if you notify the retailer quickly, but there is no definition of quickly, it may be as little as 7days. We can`t get the tv back in 7 days, altho` he has already notified Comet. Theoretically it is their problem to pick up the tv, but whether they will or not?

We made it quite clear when buying that we were taking the tv off the mainland and bought an extended warranty (given my tv history!) and were told it would be no problem.

I got a new HDTV from John Lewis, and the HDMI connector was farked on it. Called them up, and they delivered a new one, and took the old one away. Turnaround was in a couple of days, absolutely no quibbles. I`m sorry, but if you buy something, and its f***ed, you SHOULD get a replacement.

You are absolutely entitled to a new TV.
Another reason not to buy from twats like these!!! >:(
Sale of Goods Act. Even within 6 months they would have to prove the TV didn`t have a fault.
DO NOT ACCEPT A REPAIR!!!!!!!!!!!!

Even s***ty retailers offer a new product within 4 weeks so only accept a brand new set.

Absolutely correct. Your sole legal entitlement is to a refund. If you allow a repair you are implicitly accepting the goods, and significantly weakening your position if you subsequently want a refund.

Think it`s ropey as to whether you`re entitled to a refund in this case due to taking it off the mainland.
You ARE entitled to a working unit and in the case of some retailers (dependant on their manufacturer agreements) they usually change them over.
To wait 3 weeks for a resulting repair is unnaceptable though, they should have an Engineer confirm the fault and move the repair on much faster than that and personally I`d be pushing for a couple of days tops or asking for replacement unit.

On the tuner point...I take it the TV system is exactly the same where you are or that you have set the TV to the right frequency range etc. in it`s menus?
Do external inputs work like a DVD player?

I`m really surprised to see Comet act this way so fast, they`re usually reasonably decent. Don`t deal with their customer service centre, deal direct with the branch. Customer Service number didn`t even know they sold a hifi that took an iPod when I rung them about non-compatibla adapters and told me to ring apple...<off went I into the SOG act etc etc)

You made it clear you were going off the mainland so I`d say you`re pretty safe there, and you are right that Comet should recover the goods but I think it might be ropey because you went over the water :/

Best advice I could really give is keep EVERYTHING documented, phone calls, names, times, everything.
Then get in touch with Consumer Direct because they`ll be in a much better position to advise as to how the SOG act affects your position.

I`ll ask a couple of mates in Comet branches next week when I visit them and ask if they can give me any advice for you too.

The way i see it, even if it is dead out of the box you are still claiming on the warranty. I am guessing the warranty is "return to base" This means you are responsible for getting it back to them.

Even with this in mind I would be pushing for a new set.

If you bought a car, and the minute you sat in it the engine died, there`s no way you would accept a repair. When you buy something `new`, you expect a good lifespan from it. If you can`t use the goods then I feel that the company should do their utmost to fix the problem. Whatever happened to customer service?

Saying that, taking it out of the mainland I guess does change things. When you bought it, what address did you give?
