eBay problem/question - any advice...?

For one of the few times I can remember, I actually have a little problem regarding eBay: I bought a Queen LP for £20 off a seller (with good feedback - only 1 neg). I asked him if he could make sure to pack it very well, and preferably in a box - as I am a collector and LPs often get creased/bent in the post. He said he would, and charged £5 for P+P. So I paid by Paypal - but I received the LP yesterday, and it was just wrapped in bubble-wrap and brown paper (and the actual postage cost was £2.10) - and heavily creased/bent in 2 corners...

So I e-mailed the seller saying how it had arrived etc., and that I would like a refund - and this is his response:

As the fault is not mine but the Royal Mails then I do not accept liability and will therefore not be giving you a refund. When I sent it the item was in perfect condition. It was like new.

If you are unhappy then you will either have to claim from the Post Office or sell on the record yourself if you want to recover your money.

Try to see it from my point of view, if I give you a refund and then tried to sell it again, what success would I have with a slightly damaged item now?

Being cold and harsh about it, the problem is not mine now. Once I have posted goods I no longer own them.

I`m a bit p***ed off about this to be honest and am not sure what to do. He has already left me positive feedback (so I`m alright there!), but should I leave him negative - or try and get my money back through PayPal?

They tend to favour the buyer in these situations anyway don`t they? So you`d be justified in that and negging him - just be honest about it, what have you got to lose?

(Then post it back to him wrapped in crepe paper - say you couldn`t find anything better to post in)

Distance-selling regs say it`s his responsibility to get it to your house safely - he didn`t even take it out of his properly-packed! *He* has to claim from the Royal Mail, if he wasn`t f***wit you could be nice and wait til he has his money back to refund you - but don`t, get your money from Paypal first. And whatever you do - *send it back by TRACKABLE MEANS!!!

And neg neg neg.

Leaving you +ve feedback then sending that response! Totally different class of twat! I would get my money back from Paypal (make sure you put all the details in, maybe exaggerate a little because they tend to favour buyers) also mention that you HAVE been in contact.

Don`t bother sending it back, after all...

Got a bit of a similar problem meself at the mo.
Bought a Marantz amp off Ebay, and it turned up with a minute amount of bubblewrap covering it, wrapped in brown paper! Needless to say, it was completely effed!

Immediately got in touch with seller, who had the cahoneys to claim that it was sent in a box, even tho I have retained all the `packaging`.

Straight onto PayPal, file a claim, and immediately negged him.

Watch this space!
