Dodgy Deals at Deep Discount

BritBoB (Mostly Harmless) posted this on Monday, 18th September 2006, 10:48

I made use of the Buy One Get One Free Offer at Deep Discount last month. I received my first DVD after a few days then yesterday I noticed that the 2nd DVD had been cancelled in my account saying it was no longer available. I emailed them asking why it had been cancelled and they replied that I shouldn`t worry as I haven`t been charged for it!

I think they might have missed the point. I ordered 2 DVD`s on a BOGOF and they have sent me one DVD at full price! This is a very dis honest trick as I would not have bought either DVD at full price. I have wrote back to them and am waiting or a reply.

Should be interesting to hear how they counter that argument

Their reply to my email was:

You were charged only $23.99 for the item ABD013215 (EVIL DEAD 2-BOOK OF THE).
We are not responsible for items that are discontinued by the manufacturer.
Since the special is no longer offered, we are unable to honor the 2 for 1
pricing.

This seems wrong to me. Anyone know if they are allowed to do this or not?

I`d check with your locla trading standards authority on this one. Going back to my uni days when I had to cover business law, I think it may be classed as a breach of section 1 of the act:

What are the offences under the act (relating to goods)?

Quote:
[*]The Act makes it an offence to:

Apply a false or misleading description to goods (e.g. by writing it down, making a verbal statement or by turning back a car`s odometer); or
Supply or offer to supply goods to which a false or misleading trade description is applied. A person exposing goods for supply (e.g. in a shop) or having them in his possession for supply (e.g. in a storeroom) is deemed to offer to supply them for the purposes of the Act.
These offences are strict liability offences i.e. it is possible for a trader to commit an offence without intending to do so.

You should have a look at this website for more info. I think distance selling rules may also apply as it was an online purchase.

Good luck, hope it helps. Keep us posted.

Thanks for the info Kakuzato. The link to the DTI website is interesting. These laws apply to the EU though and this is an American company so I imagine they have different laws. It`s not alot of money but it`s a bit of a principle thing really.

Well I sent another email asking to return the DVD that had been sent and get a refund. I got another reply today appologising for the inconvenience and saying I can order another DVD to the same value and they will send it free of charge.

It`s unfortunate that it took so much complaining and so many emails from me but at least they are willing to hold up their end of the deal. One thing I can say for Deep Discount is they are very quick to reply to emails!

Good for you, glad you managed to get some closure on it. Don`t think i`ll be using them soon. You may want to have a look at www.dvdconcept.com

I`ve ordered from them in teh past, they`re good value and you avoid taxes etc because they ship via Switzerland. I`ve never paid tax once in over a dozen purchases.
