Warrenty question (Ebay shop)

Got a combi microwave from an ebay shop last week, it worked fine for a few days then went kaput, (used 4 times) Now,  the seller states 7 day warrenty on the auction, & it was last friday when i bought it, but it was only delivered on wednesday,  & he`s saying i am now out of "his" warrenty period & it`s basicaly tough **** to me :(

so the question is, can he reasonably carry the warrenty from day of purchase, or should it have been from date of delivery ?  especially given he states 4-6 days for delivery, meaning if the item arrives 1 day late, it would allready be out of warrenty :/

I always understood that the warranty begins from the day of receipt, that was the rules the warranty company I used to work for alwaysstuck to, and they were pretty mean on most things!

It should reasonably start from the day of receipt.

the seller has said he wont do anything about it & is addamant he`s got no obligation at all, so i`ve just neged him & started a dispute with fleabay,  not that that will do owt :/

It has to be from the day you receive it, then there is the 7 day cooling off period.

In the case of goods, the cooling-off period normally ends seven working days after the day the goods are received.

iirc, most of the sales of goods act stuff only applies to new items ?  my issue is that he states 7 day warrenty, & i was happy enough to have a punt at it under those terms,   if it had died in a fortnight, i`d still be ****ed off, but at the end of the day i bought it under certain terms, & it would be just my bad luck,  but it only lasted 3 days, so i reckon i`m entitled to get a replacement or a refund..

he`s now saying the 7 day warrenty only applies to Buy it now customers :/

thing is, i know i`m in the right,  but ebay & paypal tend te be fairly useless when it comes to sorting this stuff out, & if ebay kick it back, then theres only the small claims court, which is obviously not worth the hassle...

anyway, after asking him where his warrenty conditions stipulate they apply only to buy it now customers he just sent me this...

Seller`s message:
"ha ha ha don`t be angry so much , this discussion depends on our negotiation, if you win i will refund you and collect my item or if i win i will not collect or refund. i am very kind person, you must have some discussion with me before leaving feedback, you see right only for yourself but hurt the other seller reputation, you how hardly to maintain the good reputation. however lets see the result."


dunno why he thinks i`m "angry" since i wasn`t nasty or agressive towards him, but hey ho.....  anyhoo,  my reading between the lines superpowers suggests he`s trying to let me know that as i`ve allready played the feedback card, i have no more cards to play so game over....

i have of course, just informed him that i can still revise my feedback in his favour if this issue can be dealt with, i`m guessing he didn`t know that could be done..
