Where do I stand on this?

Colleen Hawkins (Competent) posted this on Sunday, 16th September 2007, 20:33

Just a quick question: I recently bought three copies of the same boxset from amazon and one was damaged. I told amazon and returned the damaged boxset. Somehow amazon made a mistake and sent me out THREE replacement boxsets rather than just one. I`ve told amazon about this and they`ve just said that I have to post back the two unwanted boxsets via recorded delivery. To be honest though I don`t see why I should have to shell out money to return them (they will refund me, but it`s still annoying) and I don`t fancy wasting yet another lunch hour posting back items that they shouldn`t even have sent out to me. Given that the error is amazon`s, am I legally obligated to send them back? I have actually asked that they arrange for a courier to pick them up at a time convenient to me or that they compensate me for my wasted time, but they haven`t responded to this as yet (and I`m pretty sure they`ll say no anyway). If I refuse to send them back, are amazon legally entitled to charge me for them, even though they sent them out in error?

Probably I haven`t got a leg to stand on here and there`s a boring lunchtime of queuing awaiting me sometime this week, but I thought it was worth asking. People seem pretty clued up on here :)

Not too sure but as the dispatch/delivey of the items were as a result of a mistake by Amazon they still have the right to their return. However I believe that as long as you make them available for a courier to collect for a reasonable time period and are not obstructive then that is all you need to do.

I`m sure when I`ve sent stuff back to Amazon I just had to print off a label and it was Freepost.

You shouldn`t of said anything and sold them on e-bay.

You should hold them available for collection for a reasonable period of time. It is their responsibility to collect the goods.

Thanks everyone.. That does clarify things and its good to know that the onus is on them (so long as I`m not obstructive, which I wouldn`t be). I did toy with the idea of not mentioning the error to amazon, but I was pretty sure it would come to light when they checked in the boxset I returned.
