Apple say they tried to help FBI but someone changed the iCloud password:

The idea was to force the iPhone 5C to auto-backup to Farook’s iCloud account. With a legal court order, Apple can and does turn over iCloud data...

..but [Apple] soon found out that the Apple ID account password had been changed shortly after the phone was in the custody of law enforcement, possibly by someone from the county health department. With no way to enter the new password on the locked phone, even attempting an auto-backup was impossible. Had this iCloud auto-backup method actually functioned, Apple would have been easily able to assist the FBI with its investigation.

Tim Cook has given an interview on the situation

I have a question.
What's the situation with Android devices? Do I assume that the FBI can just kick the door in and walk through any Android device?

I used to be with it, but then they changed what `it` was.
Now, what I`m with isn`t it, and what`s `it` seems weird and scary

Apple engineers have begun developing new security measures that would make it impossible for the government to break into a locked iPhone using methods similar to those now at the center of a court fight in California, according to people close to the company and security experts.

No, if encryption is switched on, the situation is the same.  But you would also need to consider there's probably lots more phones out there with 'older' versions of Android than those with older iPhones.  Older versions of software didn't support encryption anyway.

Regarding Apple themselves making a newer IOS version that 'even they' can't hack, most people were under the impression that was the situation we were already in...  Until the 'suggestion' of effectively installing a 'custom firmware' developed by them that removed the restrictions on timeouts etc. currently in place.

I wonder if the FBI could make my iPhone work again after the last update turned it into a brick...

Aren't they unbrickable? I've yet to come across an idevice that I couldn't get working again. Admittedly it often involves recovery mode, itunes and a complete reset but data can be restored if you have backed-up often enough.
