Thinking on a devils advocate approach, you could hypothetically use the above as a good excuse, after you have shot your girlfriend in the heat of an argument, then saying 'I thought it was an intruder. Me lady!'

So the jury is still out on this case.

Sorry, there is no jury, just the judge. We wait and see.

For me though, there's far too many inconsistencies and plain changes of story to make that likely or probable in this case.  But that's for 'My Lady' to decide I suppose.

Beyond reasonable doubt.
Balance of probability.
Do they have an equivalent to the Scottish 'Not Proven' and as he's already admitted taking her life what's he down for if sentenced for that.

i.e. you appeared to say that because he lives in a country (but you don't) where it's possible... that you "can fully believe Oscar was fearing for his life".

The chance of getting your head caved in at night while you sleep is horrifically more possible there. Another win win day for the Prosicution...

Today the defence brought in their 'paid expert' to explain the cricket bat noises sounding like shots, (still sounded like cricket bats to me), and then he discussed the bullets going through the door, as more an instant death with the girlfriend just falling over to the ground, as each bullet was pumped in, with no chance of a sound before dying.

This seemed totally illogical to that of the detail given a few weeks ago by the police of what happened behind that door as the bullets went in. Re: the time taken to make a defensive position, a time to scream?

The defence then really tore the 'so called expert' apart as having no credentials on criminology, other then a degree in geology (rocks).  His 'expert' evidence was totally on the rocks by then. (see what I did there )

There are more defence witnesses to follow next. Maybe they will make a better job of it.

I Hope I am wrong, but its OJ 2.0, he obviously did it but his money I think will get him off

Yeh, one had a slow car chase as a gimmick , and the other a bucket for wretching 

The Defence witness, a gun expert with 40 years experience seemed to mumble his way through the timing sequences of the gun firing. Lazers were used to show projectile direction, but his evidence was very shambolic and poorly put.

English to him was rather difficult and used that as an excuse for the above. Not very professional for a trial like this being televised worldwide.

In counter to the above, the state prosecution 'police expert' a few weeks ago clearly put a better case on how her body fell due to the gun fire, and said that after the first bullet to the hip, she had time to move into a defensive position, and so could have time to cry or scream out to Pistorius.

This as stated before is the MOST crucial evidence of all, as it is the difference between premeditated murder, or a sorrowful accident.
